LO, TCO, Saco och Svenskt Näringsliv har nu presenterat sitt förslag på hur man vill begränsa konflikträtten. Grundbulten i förslaget är en inskränkning i konflikträtten som förhindrar fackliga stridsåtgärder som inte syftar till att få till ett kollektivavtal. Samtidigt menar de att det inte inskränker löntagarnas demokratiska rätt att strejka, utan att det bara skapar ”lika villkor” för alla fackföreningar i Sverige. Det finns en hel del att säga om detta (även om vi vill förtydliga att vi ännu inte kunnat läsa hela lagförslaget och att det fortfarande råder lite oklarheter kring vissa bitar).
För det första är det uppenbart att LO, TCO och Saco helt anammat Svenskt Näringslivs retorik när de beskriver konflikten i Göteborgs hamn. Man beskriver det som att Sverige ”har plågats” av hamnkonflikten och att den har ”hotat den svenska modellen”. När man dessutom säger att syftet med förslaget är att ”hindra missbruk och avarter” av den svenska modellen är det uppenbart att man syftar på exempelvis SAC och Hamnarbetarförbundet. Att vi fristående fack skulle ”missbruka lagen” när vi tar strid för våra medlemmar är en verklighetsbeskrivning vi inte kan ställa oss bakom. Man är inte en ”avart” bara för att man inte vill skriva kollektivavtal!
För det andra visar detta utspel att LO, TCO och Saco-facken är mycket måna om att befästa sin egen dominans på svensk arbetsmarknad och att lagförslaget i praktiken innebär att man tränger ut den frihetliga fackföreningsrörelsen från allt inflytande. Centralisering, toppstyrning och samförstånd är den modell alla ska rätta sig efter och för oss är det synonymt med att arbetarna också får mindre inflytande på sina arbetsplatser. Med deras förslag innebär det ju att alla arbetare på en arbetsplats måste rätta sig efter ett kollektivavtal, även om det är skrivet av ett fack de inte sympatiserar med eller ens är medlem i. Vi kan inte se det på något annat sätt, än att friheten att låta sig representeras av ett alternativt fack försvinner.
Slutligen vill vi påminna om att vi aldrig kommer acceptera en inskränkning i konflikträtten – vare sig det handlar om förslaget vi hörde idag eller en framtida regerings version. Lo,tco, Saco and Swedish enterprise have now presented their proposal on
how to limit the quality of life. The Linchpin of the proposal is a
restriction on the rule of law which prevents trade union industrial
action which is not intended to have a collective agreement. At the same
time, they believe that it does not restrict the democratic right of
workers to strike, but that it only creates ' equal condition s' for all
trade unions in Sweden. There is a great deal to say about this
(although we would like to make it clear that we have not yet been able
to read the whole bill and that there is still some confusion about
certain pieces).
First of all, it is clear that lo, tco and saco fully embraced Swedish
enterprise rhetoric when they describe the conflict in gothenburg port.
It is described as that Sweden ' has been plagued ' by hamnkonflikten
and that it has ' threatened the Swedish Model ', when it is also said
that the aim of the proposal is to ' prevent abuse and drifts ' of the
Swedish model it is obvious that you are referring to For example, sac
and hamnarbetarförbundet. The fact that we stand-alone compartments
would "abuse the law" when we fight for our members is a
verklighetsbeskrivning we cannot stand behind. You're not a "this" just
because you don't want to write collective agreements!
Secondly, this move shows that lo, tco and saco are very keen to
consolidate their own dominance in the Swedish Labour market and that,
in practice, the bill means that the libertarian trade union movement is
being removed from all influence. Centralisation, top and consensus are
the model everyone should comply with and for us it is synonymous with
workers also having less influence in their jobs. With their proposals,
it means that every worker in a workplace must comply with a collective
agreement, even if it is written by a compartment they do not sympathise
with or even a member of. We cannot see it any other way than that the
freedom to be represented by an alternative compartment disappears.
Finally, we would like to remind you that we will never accept a
restriction on the issue of trade - whether it is about the proposal we
heard today or a future government version. Sac stands up for the right
to strike, for the right of hamnarbetarförbundet and the free movement
